1. Purpose

This site is operated by Dr James Condon for men's health education and information, approved research, and the provision of regulated telehealth clinical services, described below.

2. Clinical Services (Current Status)

Drjames.au provides regulated telehealth clinical services, including medical consultations (by phone or video), clinical assessment, and, where clinically appropriate, prescriptions. Consultations are conducted by Dr James Condon, an Australian doctor and GP registrar, in compliance with Australian law and applicable professional standards.

To support your clinical care, we operate our own electronic medical record (EMR), separate from the general website, in which your consultation record, clinical notes, medications, and correspondence are stored. See our Privacy Policy for how this data is stored, retained, and protected.

3. Clinical Decision-Making and Use of Software

Every clinical assessment, diagnosis, and treatment decision made about your care is made solely by Dr James Condon. No artificial intelligence (AI) or large language model (LLM) is used to generate, score, or recommend any part of your clinical assessment or treatment plan. This is a hard rule of our platform, not a design choice that may change without notice.

Software on this platform is used only to compile Dr James Condon's own clinical decisions into a document (a mail-merge style function operating over choices the clinician has already made). It does not generate, infer, or suggest clinical content. Dr James Condon reviews and is responsible for every document and communication issued in relation to your care.

4. No Medical Advice from General Site Content

Content on this site outside of your individual consultation, including blog articles, educational materials, and general informational pages, does not constitute medical advice, diagnosis, or treatment, and is not a substitute for your own consultation with Dr James Condon or another qualified health professional. Some general educational materials (e.g. information leaflets) may be drafted with the assistance of an AI writing tool and are reviewed and approved by Dr James Condon before publication; these remain general information, not personalised advice, and are never generated using your personal health information.

5. Questionnaires and Forms

Clinical intake questionnaires completed as part of booking a consultation are used by Dr James Condon to inform your assessment and treatment. They are a real part of your clinical care, not a general survey. Separately, other questionnaires or forms on this site (e.g. research surveys, waitlist forms) are for informational, research, or service-development purposes only and are not used for your diagnosis or treatment. Participation in any research activity only occurs following approval by a registered Human Research Ethics Committee (HREC) and will be clearly identified as such.

5A. My Health Record and Sharing Information with Other Practitioners

Where you consent, Dr James Condon may view relevant parts of your My Health Record to inform your care, and/or share a summary of your consultation with your nominated GP or request records from your previous treating practitioners. These are optional and can be declined without affecting your ability to receive care. Full detail is in our Privacy Policy.

6. Acceptable Use & Community Guidelines

  • Post Prohibited Content: including hate speech, discrimination, harassment, threats, nudity, sexual content, violence, promotion of self-harm, and harmful misinformation.
  • Engage in Prohibited Conduct: including unlawful activity, unauthorized access, malware introduction, disruption of the platform, or use of automated tools without consent.
  • Respect Intellectual Property: Only share content you have the right to post. No uploading copyrighted materials without the owner’s consent.

We reserve the right to remove any content that violates these rules, and to suspend or terminate accounts without notice for breaches.

7. Intellectual Property

All website content is owned by Dr James Condon. You may not copy, distribute, or use any part of this content without express permission.

8. Data Privacy and Security

Use of this site is subject to our Privacy Policy. No data will ever be sold. Data collected may be used for internal service development and, if deidentified, for public transparency with opt-out options available.

9. Security Measures

We use industry-standard technical and organisational measures to protect the platform and its data, including encryption, secure hosting environments, and regular system monitoring. However, no method of transmission over the internet or method of electronic storage is completely secure.

10. Changes to Terms

We may amend these Terms of Use at any time. Any changes will be posted on this page, and your continued use of the platform after such changes have been posted constitutes your acceptance of the revised Terms.

11. Platform Availability and Limitations

To the extent permitted by law, Dr James does not guarantee uninterrupted or error-free operation of the platform, compatibility with your systems, or that the site will be free from viruses or other harmful components.

12. Consultation fee-refund policy

drjames.au offers two fee-refund promises on any consultation booked through the platform. These promises apply from the date consultation bookings become available.

12.1 Consultation satisfaction refund. If, after the consultation, you are not satisfied with the consultation itself, you may request a full refund of the consultation fee.

12.2 No-prescription refund. If, after the assessment, no prescription is issued and no further care from drjames.au, including follow-up consultation, requested pathology, or referral, is planned, you may request a full refund of the consultation fee.

12.3 Claim window. Refund requests must be submitted within 14 days of the consultation, in writing to admin@drjames.au. Requests submitted after 14 days will be considered on a case-by-case basis but are not guaranteed.

12.4 How refunds are processed. Approved refunds are returned to the original payment method within 10 business days of approval. You will receive an email confirmation when the refund is processed.

12.5 Scope of these promises. These are fee-refund promises related to the drjames.au consultation service. They are not therapeutic outcome guarantees. All clinical decisions, including whether a prescription is issued, whether follow-up is required, and whether specialist referral is indicated, are made on their clinical merits and are not influenced by the refund policy. Nothing in this clause limits your rights under the Australian Consumer Law or your rights as a patient under the Australian Charter of Healthcare Rights.
